Pechi Pechi Penguin 日本語

This is an English translation of the Japanese original. If the two differ, the Japanese version prevails.

Terms of Service

Effective: November 12, 2026

These Terms of Service (the "Terms") set out the conditions for using the game Pechi Pechi Penguin (the web, iOS and Android versions; the "Service") provided by KUDs ("we").

Article 1 (Application and agreement)

  1. These Terms apply to everyone who uses the Service ("players").
  2. We show in advance, in the Service and on our website, that these Terms form the contract for using the Service. When a player uses the Service, the player is deemed to have agreed to each provision of these Terms.
  3. The Service is intended for people aged 13 and over (how we handle players we learn are under 13 is in section 7 of the Privacy Policy).
  4. Minors must have the consent of a parent or other legal guardian before using the Service, and must always have it before buying paid items.

Article 2 (The Service)

  1. The Service is an air hockey game in which you control penguins and hit a puffer fish. You can play against the computer, as two players on one device, and against other players over the internet ("online matches").
  2. The Service is free to play. Some in-game currency and items can be bought (Article 6).
  3. We plan to add ads to the apps in a future update, watched only by players who choose to (the apps and the web version have no ads now). Watching an ad gives rewards such as opening a chest sooner (up to 3 times a day). The ads are shown by Google's AdMob (Privacy Policy 2.9). Players under 13 are not shown the button to watch ads.
  4. The Service is provided for people in Japan. Purchases are for Japan, and prices are in Japanese yen. The English text is for people in Japan who use English.

Article 3 (Accounts)

  1. You can play without signing in. The first time you use an online feature, such as online matches, a temporary ID (the "account") is created on your device.
  2. If you sign in with an Apple or Google account, you can use the same account's records and purchased items on several devices (including the web). The sign-in available is Apple in the iPhone and iPad apps, Google in the Android app, and Apple and Google on the web.
  3. If the device you sign in on has other records, both are shown on screen for you to check. Only if you choose to discard this device's records do we delete them and switch to the signed-in account's records. Discarded records cannot be restored. At that point, paid gems, costumes and the fish's looks, characters, stamps, this season's Season Pass Deluxe, the remaining period of the Monthly Pass, purchase records and coins from purchases move to the signed-in account. The coins moved are the total that purchases not refunded gave, or the coins left at that moment, whichever is smaller. Coins beyond that, free gems, cards, character levels, chests, season pass progress, missions and trophies do not move, and are lost.
  4. Players who do not sign in, and players moving to a device where the same sign-in is not available (between iPhone and Android, for example), can move their records to another device with a code issued under "Transfer" in the game (usable once within 24 hours). After the move, the account on the original device can no longer be used. If the device you enter the code on has purchased items, both records are shown on screen for you to check as in paragraph 3, and only if you choose to discard this device's records do we move the same items as in paragraph 3 to the code's records and delete the rest. If it has no purchased items, it switches without asking, and the records it had until then can no longer be used.
  5. The key to the records of a player who has not signed in exists only in that device's browser or app. If the key is lost, for example because you clear the browser's data, the browser removes old data by itself, you delete the app or you lose the device, the records and purchased items can no longer be used, and we cannot restore them. We recommend signing in with Apple or Google before you buy.
  6. Players must look after their account, transfer codes and sign-in methods themselves, and must not let third parties use them, or give or sell them to others.

Article 4 (Online matches and interaction between players)

  1. The names shown in online matches are only combinations of words provided by the Service. There is no free text input or chat; players can interact only through the stamps provided by the Service, friend requests and invitations to rooms.
  2. Trophies go up or down with match results. We may revise trophies, bands and rankings each season in ways we decide.
  3. When no opponent is found, you may play against an opponent that borrows a recent player's name, character, level and so on (a "ghost"). Ghosts are played by the computer and are shown as ghosts on screen. In the game's Settings, you can choose not to lend your look to ghosts.
  4. You can send friend requests to other players after a match, in the waiting room, or by their friend number. You can remove or block friends at any time. The other player is not told that you blocked them.
  5. You can share links to match replays and to watch matches. Replay and spectator screens show the names (combinations of words) of the players in the match and what happened in it.

Article 5 (In-game currency and items)

  1. The Service has two in-game currencies, "coins" and "gems".
    • Coins: earned by playing, as rewards, and by exchanging gems. They are also included in the paid "Starter Pack". Coins are never sold on their own.
    • Gems: there are "paid gems", obtained by buying them, and "free gems", obtained by playing, as rewards, from the Monthly Pass and so on. The wallet screen and the history show paid and free gems separately. Free gems are used first.
  2. In-game currency and items (characters, cards, costumes, stamps, chests and so on) can be used only within the Service. They cannot be exchanged for cash or for other services' points, or given to other players.
  3. Gems (paid and free) and items do not expire. However, they can no longer be used if your account is deleted under Article 11, your use is suspended under Article 10, or the Service ends under Article 12.
  4. Paid gems are prepaid payment instruments under Japan's Payment Services Act. The notice under that Act is on the Notice under the Payment Services Act page.
  5. The contents of chests and of the gacha are decided on our server according to the probabilities shown on their screens.

Article 6 (Purchases)

  1. Purchases in the apps are made through App Store or Google Play in-app purchases, and purchases on the web through payment by Stripe. Prices are shown on the purchase screen.
  2. The items sold include gem packs (such as "80 Gems"), the "Starter Pack" (once per account), the "Season Pass Deluxe" and the "Monthly Pass". What each contains is shown on the purchase screen.
  3. Each item grants gems or items every time it is bought. Purchased gems and items are recorded to your account and can be used on the devices that play with the same account. They are not restored by the stores' "Restore purchases" feature (to move an account to another device, use the methods in Article 3).
  4. Minors have monthly spending limits. At your first purchase (or the first time you watch an ad) we ask for your year and month of birth; the limit is 5,000 yen a month under 16, and 10,000 yen a month from 16 to under 18. Age is counted as if your birthday were the last day of your birth month. Players under 13 cannot make purchases (they can from the month after the month they turn 13).
  5. Once a purchase is complete, it cannot be canceled except where the law or the store's rules allow it.

Article 7 (Season pass and Monthly Pass)

  1. Every player has the season pass for free. Buying the Season Pass Deluxe lets you also receive the rewards on that season's deluxe tiers. If you buy it partway through a season, you still receive the rewards for the tiers already reached. The deluxe pass is valid only during the season in which it is bought and does not carry over to the next season. Rewards not taken by the end of a season (on the free tiers and the deluxe tiers alike) are not taken for you, and cannot be taken in the next season.
  2. Once ads are added to the apps, while you hold the Season Pass Deluxe you can receive the rewards for watching ads (such as opening a chest sooner) without watching.
  3. A season is a period we set (as a rule, from 4:00 a.m. Japan time on the first Thursday of each month until the next season starts).
  4. Buying the Monthly Pass gives you 300 paid gems at once. For 30 days from the time of purchase, you also receive 40 free gems when you collect your daily reward (a day ends at 4:00 a.m. Japan time; the daily reward is collected when the game's title screen appears, or with the button on the home screen). If you buy after collecting that day's daily reward, you receive that day's 40 gems when you buy (unless you have already received them that day). It does not renew automatically. Days you did not collect cannot be collected later, and the period is not extended. You can buy it only when 30 days or less remain, and buying extends the period by 30 days.

Article 8 (Refunds)

  1. Refunds of in-app purchases follow Apple's or Google's rules. For refunds of web purchases, contact us.
  2. When a refund is made, we deduct the gems and items granted for the refunded purchase. If there are not enough gems to deduct, your gem balance becomes negative, and you cannot use gems until it is no longer negative. The same applies when a card dispute reverses the payment; if the dispute is rejected and the payment comes back, what was deducted is returned. However, nothing is deducted for a refund under Article 12, paragraph 2.
  3. If a defect in the Service kept you from receiving a purchased item, contact us. After checking, we will grant the item or give a refund.
  4. A purchase made by a minor without the consent of a legal guardian may be cancelled under the law. If you want to cancel one (including legal guardians), contact us. For in-app purchases, you can also use each store's refund procedure.

Article 9 (Prohibited conduct)

Players must not:

  1. Act against the law or against public order and morals
  2. Play automatically with programs or the like, or modify or analyze the Service's communications, programs or data
  3. Exploit bugs to obtain records, in-game currency or items
  4. Disturb other players, for example by disconnecting on purpose again and again
  5. Manipulate trophies or rankings unfairly, for example by arranging to let each other win
  6. Buy or sell accounts, in-game currency or items for cash or the like, or advertise doing so
  7. Pretend to be other players, or use other players' accounts
  8. Interfere with the running of the Service
  9. Do anything else similar to the above that causes specific trouble for other players or for the running of the Service

Article 10 (Action against violations)

  1. If a player violates these Terms, or calculation mismatches or cheating are found, we may void the match and remove it from trophies and rankings.
  2. If a player violates Article 9 seriously, we may suspend all or part of the player's use of the Service or delete the account. We tell the player the reason in the Service or on our website beforehand. However, when we must act quickly to prevent harm to other players or trouble with the Service, we tell the player afterward.
  3. If you object to action under paragraph 1 or the preceding paragraph, contact us. We will check and reply. If it turns out to be a mistake, we will put things back or refund the purchase payment.
  4. If we suspend use or delete an account because of a violation of item 2, 3, 5, 6 or 7 of Article 9, we do not refund that player's unused paid gems or purchase payments.

Article 11 (Deleting your account and records)

  1. You can delete your account (your records, if you are not signed in) at any time from Settings → Account in the game. We ask you to confirm twice before deleting.
  2. Deletion removes your trophies, ranking records, in-game currency (including paid gems), items and friends, and cannot be undone. They also stop working on the other devices that use the same account.
  3. Paid gems left in the account are not refunded on deletion. The screen tells you this before deleting.
  4. Purchase records are kept for legal and accounting purposes. The link to your account is removed, but the transaction number stays (Privacy Policy section 6).

Article 12 (Changes, interruption and end of the Service)

  1. We may change the Service, or interrupt it temporarily for maintenance or because of failures.
  2. We may end the Service. If we do, we will announce it in the Service or on our website at least 60 days in advance, and stop selling paid items when we announce it. Season Pass Deluxe and Monthly Pass sold before the announcement run out by the day the Service ends. However, if a Monthly Pass would run past that day, for example because it was bought on several devices at the same moment, we refund the days past it, at the price paid divided by 30 days (fractions of a yen rounded up). We refund web purchases through the payment. We may not be able to refund App Store or Google Play purchases through the store, so contact us and we will explain how you will be refunded, such as by bank transfer.
  3. Even when the Service ends, unused paid gems are not refunded except as required by law. If the Service ends after we have filed a notification under the Payment Services Act, we will refund them as that Act requires, and explain how and by when in the announcement of the end.

Article 13 (Intellectual property)

Copyright and other intellectual property rights in the Service belong to us or to their rightful holders. Except for playing privately, using the Service's sharing features, and using the Service's screens to introduce it or in live streams, players must not use the Service's content without permission.

Article 14 (Disclaimer)

  1. We are not responsible for interrupted matches or lost records caused by communication failures, device problems or other reasons not attributable to us.
  2. If a player suffers damage through the ordinary negligence of us or anyone we employ, our liability is limited to ordinary damages actually incurred, up to the greater of JPY 1,000 and the amount the player paid for the Service (including through the stores) in the 12 months before the damage occurred. This limit does not apply to intentional misconduct or gross negligence.

Article 15 (Changes to these Terms)

We may change these Terms in accordance with the provisions on standard form contracts in Japan's Civil Code. When we do, we will announce the changes and the date they take effect, in the Service or on our website, before that date.

Article 16 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. Any dispute concerning the Service will be resolved in the court with jurisdiction under the law.
